CLASSIC WOODCRAFT – TERMS OF SERVICE

IMPORTANT NOTICE

Nothing in these Terms excludes, restricts or modifies any right or remedy you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). Where applicable, statutory rights and obligations relating to building products under Victorian legislation may also apply.

OVERVIEW

Welcome to Classic Woodcraft. In these Terms, “Classic Woodcraft”, “we”, “us” and “our” refer to Classic Woodcraft Pty Ltd (ABN 69 162 659 421) of 2/60 Jersey Road, Bayswater VIC 3153, Australia, phone +61 3 9738 0266, email peter@woodturn.com.au.

We operate this website and online store, together with all related information, content, features, tools, products and services (collectively, the “Services”). The Services are hosted on Shopify Inc.’s platform.

By accessing or using any part of the Services, you confirm that you have read, understood and agree to be bound by:

these Terms of Service (“Terms”);
our Privacy Policy; and
our Returns, Refunds & Consumer Guarantees Policy.

If you do not agree, you must not use the Services.

1. ACCESS & ACCOUNTS

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. You agree to provide current, complete and accurate information and to keep your account credentials confidential. You are responsible for all activities that occur under your account.

2. OUR PRODUCTS (TIMBER VARIATION & SPECIFICATIONS)

We take reasonable care in presenting product descriptions, images and specifications. However:

timber is a natural product and colour, grain, texture and finish may vary;
colours may appear different depending on lighting and screen settings; and
dimensions may be nominal and subject to reasonable manufacturing tolerances.

We may update, change, discontinue or limit products at any time without notice.

3. ORDERS

Your order is an offer to purchase. We may accept or reject any order for any reason (for example, stock availability, pricing errors, suspected fraud, compliance concerns, or delivery limitations).

An order is only confirmed when we issue an order confirmation and receive cleared payment (unless otherwise agreed in writing).

Your statutory rights and our voluntary change-of-mind policy are set out in our Returns, Refunds & Consumer Guarantees Policy.

4. PRICES, TAXES & BILLING

Prices are shown in Australian dollars (AUD) and include GST unless stated otherwise. Shipping and other charges (if applicable) are shown at checkout.

You authorise us to charge the payment method you supply for the total amount shown at checkout. You agree to provide current, complete and accurate billing and contact information.

5. SHIPPING, LEAD TIMES & RISK

Estimated dispatch and delivery timeframes are estimates only and may vary due to factors outside our control.

Unless otherwise required by law, risk of loss passes to you when the goods are handed to the carrier. You are responsible for unloading, site access, storage and care of goods once delivered.

6. BUILDING PROJECTS, PROFESSIONAL USE & COMPLIANCE

Some products may be used in building or renovation projects and may be subject to site-specific requirements.

You (and/or your builder, engineer or relevant professional) are responsible for:

confirming product suitability for your specific project and site conditions;
complying with applicable building codes, permits, standards and installation requirements; and
ensuring correct installation, treatment, finishing and maintenance (where required).

We provide product information as general guidance only and do not provide on-site engineering, certification, or project-specific compliance advice.

Nothing in these Terms limits liability for supplying unsafe, defective or non-compliant goods where the ACL applies.

7. INTELLECTUAL PROPERTY

All content on the Services (including text, photographs, graphics, logos, trademarks, video and code) is owned by or licensed to Classic Woodcraft and protected by applicable intellectual property laws.

You may view and use the Services for personal, non-commercial use only. You must not reproduce, distribute, modify, publish or exploit any content without our prior written consent.

8. OPTIONAL TOOLS & THIRD-PARTY LINKS

The Services may include third-party tools or links. These are provided “as is” and “as available”. We are not responsible for third-party content, privacy practices, or any transactions you enter into with third parties.

9. RELATIONSHIP WITH SHOPIFY

Shopify provides the e-commerce platform that enables us to sell products. Purchases are made from Classic Woodcraft, not Shopify. Shopify is not responsible for any claims relating to products or orders.

10. PRIVACY

Personal information is handled in accordance with our Privacy Policy. By using the Services, you acknowledge that your information may be processed by Shopify and relevant service providers in order to provide the Services.

11. USER CONTENT & FEEDBACK

If you submit content (such as reviews, photos, testimonials, suggestions or other materials), you grant us a royalty-free, worldwide, perpetual licence to use, reproduce, publish and display that content for business purposes (including marketing), unless prohibited by law.

You warrant that you have the rights to submit such content and that it does not infringe any third-party rights or breach any laws.

12. ERRORS & OMISSIONS

We may correct any errors, inaccuracies or omissions at any time, including after an order has been placed. If we cancel an order due to an error, we will provide a refund for any amounts paid.

13. PROHIBITED USES

You must not use the Services:

for any unlawful purpose;
to violate any applicable laws or regulations;
to transmit malware or interfere with the security of the Services;
to collect or misuse personal information of others; or
to attempt to gain unauthorised access to systems or accounts.

We may suspend or terminate access to the Services if you breach these Terms.

14. TERMINATION

We may terminate or suspend the Services (or your access to them) at any time. Any provisions intended to survive termination will survive, including intellectual property, disclaimers and limitation of liability provisions.

15. DISCLAIMER OF WARRANTIES

To the extent permitted by law, the Services and products are provided “as is” and “as available” without warranties of any kind (express or implied). This includes (without limitation) implied warranties of merchantability or fitness for a particular purpose.

This section does not limit your rights under the ACL.

16. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Classic Woodcraft is not liable for any indirect, incidental, special or consequential loss (including loss of profits, data, goodwill or business interruption) arising out of your use of the Services or products.

Where liability cannot be excluded under law, our liability is limited (at our option) to:

replacing the goods;
repairing the goods;
resupplying the goods; or
paying the cost of replacement, repair or resupply.

This section operates subject to the ACL and any non-excludable rights.

17. INDEMNITY

You agree to indemnify and hold harmless Classic Woodcraft and its officers, employees and agents from any claim arising from your breach of these Terms or misuse of the Services, to the extent permitted by law.

18. SEVERABILITY

If any provision of these Terms is held invalid or unenforceable, that provision will be severed and the remainder will remain in force.

19. ENTIRE AGREEMENT

These Terms, together with the policies referenced in them, constitute the entire agreement between you and Classic Woodcraft regarding the Services.

20. ASSIGNMENT

You may not assign your rights under these Terms without our prior written consent. We may assign our rights and obligations without notice where permitted by law.

21. GOVERNING LAW

These Terms are governed by the laws of the State of Victoria and the Commonwealth of Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria.

22. CHANGES TO TERMS

We may update these Terms from time to time by posting an updated version on our website. Changes take effect from the date they are published. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
